1. Acceptance of Terms

By creating an account or using Pigeon Email, you agree to be bound by these Terms and Off Script Foundry, Inc.'s Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

Pigeon Email is an email management application that connects to your Gmail account to provide:

• An alternative email inbox interface
• AI-powered email prioritization and classification
• Email filtering and organization tools
• Sender screening for unknown contacts
• Smart reply suggestions
• SMS alerts for urgent emails
• Email composition and sending

Pigeon Email is a client that works with your existing Gmail account. Off Script Foundry, Inc. does not provide email hosting or email addresses, and is not affiliated with, endorsed by, or sponsored by Google LLC.

3. Account Requirements

3.1 Google Account

You must have a Google account with Gmail to use Pigeon Email. You authorize us to access your Gmail data through Google OAuth as described in our Privacy Policy.

3.2 Accuracy

You agree to provide accurate information and keep your account details current.

3.3 Account Security

You are responsible for maintaining the security of your account. Notify us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree NOT to use Pigeon Email to:

• Violate any applicable law or regulation
• Send spam, phishing, or malicious emails
• Attempt to access other users' data
• Reverse engineer, decompile, or disassemble the application
• Use automated scripts or bots to interact with the service (beyond our intended API)
• Interfere with or disrupt the service or its infrastructure
• Circumvent any security measures or access controls

5. AI Features

5.1 Optional

AI-powered features (email prioritization, smart replies, sender classification, summarization) are optional and can be disabled in your settings.

5.2 Accuracy

AI features provide suggestions and classifications that may not always be accurate. You should review AI-generated content before relying on it, especially for smart replies and email prioritization.

5.3 Data Processing

When AI features are enabled, portions of your email content are sent to the AI provider you select—currently Anthropic or OpenAI—for processing. Under their standard commercial API terms, providers may retain inputs, outputs, or abuse-monitoring logs for up to 30 days, subject to limited legal, safety, and zero-retention exceptions. Their standard commercial API terms state that API customer content is not used to train general-purpose models unless the account holder explicitly opts in. If you supply your own provider API key, your provider account settings and agreement also apply. See our Privacy Policy for more detail.

6. SMS Alerts

6.1 Opt-In

SMS alerts for urgent emails are entirely opt-in. You must provide and verify your phone number to receive them.

6.2 Message Frequency

Message frequency varies based on your incoming email volume and urgency. You can control alert sensitivity in your settings.

6.3 Opt-Out

You can stop SMS alerts at any time by:

• Replying STOP to any message
• Disabling SMS alerts in your account settings
• Removing your phone number

6.4 Carrier Charges

Standard message and data rates from your mobile carrier may apply. Off Script Foundry, Inc. is not responsible for carrier charges.

7. Intellectual Property

7.1 Our Property

Pigeon Email, including its design, features, code, name, logo, and branding, is owned by Off Script Foundry, Inc. and protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the service; no ownership rights transfer to you.

7.2 Your Content

Your emails and personal data remain yours. We do not claim ownership of any content in your Gmail account. Our access is limited to providing the service as described.

8. Disclaimer of Warranties

Pigeon Email is provided by Off Script Foundry, Inc. “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy of AI classifications or suggestions
• Timely delivery of SMS alerts
• Compatibility with all email formats or configurations

We rely on Google's Gmail API and other third-party services. Service availability depends on these external providers.

9. Limitation of Liability

To the maximum extent permitted by law, Off Script Foundry, Inc. and its officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or emails
• Missed or delayed notifications
• Incorrect AI classifications leading to missed emails
• Service interruptions or downtime
• Unauthorized access due to user negligence

The total liability of Off Script Foundry, Inc. for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Termination

10.1 By You

You may stop using Pigeon Email and delete your account at any time through your account settings.

10.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Use the service in a way that could harm other users or our infrastructure
• Fail to pay applicable fees (if on a paid plan)

10.3 Effect of Termination

Upon termination, your cached data will be deleted within 30 days. Your Gmail account and emails are unaffected — Pigeon Email is only a client.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app. Continued use after changes constitutes acceptance.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms, and any dispute arising out of or relating to these Terms or your use of Pigeon Email, are governed by the laws of the State of Delaware, where Off Script Foundry, Inc. is incorporated, without regard to its conflict-of-law rules. The laws of any other state do not govern — including the laws of the state in which Off Script Foundry, Inc. maintains a mailing address and the laws of the state in which you reside — except to the extent mandatory consumer-protection law in your jurisdiction cannot be waived by agreement.

12.2 Dispute Resolution

Any dispute shall be resolved through binding arbitration seated in the State of Delaware and conducted under Delaware law. For any claim not subject to arbitration — including small-claims actions and requests for injunctive relief — you and Off Script Foundry, Inc. consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware, and waive any objection based on inconvenient forum. This section applies except where prohibited by law.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

14. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Off Script Foundry, Inc. regarding use of the service, and supersede any prior agreements or understandings.
